LIMITATION OF LIABILITY: TRUXELL LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SITE OR ANY VEHICLE PURCHASE.

DAMAGE CAP: OUR TOTAL LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF $500 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Truxell LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Site, violation of these Terms, or violation of any rights of third parties.

Dispute Resolution: Any dispute arising from these Terms or your use of the Site shall be resolved through binding arbitration administered by the American Arbitration Association in Phoenix, Arizona. You waive any right to a jury trial or to participate in a class action lawsuit.

Exceptions: Either party may seek injunctive relief in court for intellectual property violations or other equitable remedies.

We shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, government actions, labor disputes, or technical failures.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
